Welcome to SYNC Therapies. These terms and conditions (the "Terms") outline the rules and regulations for the use of our website and services. By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, please do not use our services.

1. DEFINITIONS

"We," "Us,", "Our", and "Therapist": Refers to SYNC Therapies.
"Client," "You," and "Your": Refers to the individual or entity using our services.

2. SERVICES

We offer therapeutic manual therapy services, including but not limited to treatments offered by SYNC Remedial Massage Pty Ltd. The specific details, timelines, and deliverables of each service will be outlined in the form of digital communication titled 'Confirmation Email' and 'Reminder Email' from a Third Party software provider, prior to your scheduled appointment.

3. USER ELIGIBILITY

By using our services, you represent that you are at least 18 years old or have the consent of a legal guardian. You warrant that any information provided to us is accurate and up-to-date.

4. FEES AND PAYMENT TERMS

Fees for individual treatments are listed in our third-party patient booking system when booking a treatment. You can access the booking portal in 'Appointments' or 'Book Now' buttons throughout the website. Payment terms are outlined in our "Make a Payment and Payment Methods" within our FAQs page. Payment is to be made at the conclusion of a treatment. A Payment invoice that is requested to be sent to a third party for payment is due within the specified timeframe on our invoices. Repeat late payments and/or non-payments of the invoices may result in disallowing the client to make future bookings.

5. INTELLECTUAL PROPERTY

All materials created by SYNC Therapies, including but not limited to promotional content, brochures, and educational materials, remain our intellectual property unless otherwise stated. Clients receive a limited, non-transferable license to use the materials for the purposes specified in our agreement or consultation. The client warrants that any content provided to us does not infringe on the intellectual property rights of third parties.

6. CONFIDENTIALITY

Private Sessions: Both the Therapist and Client agree to keep confidential all discussions during therapy sessions and agree not to share information to others without explicit client consent. Confidential information includes personal health information, personal social and family information, business strategies, client data, and other proprietary information not publicly known.

Records Protection: Client records, including clinical notes, medical imaging, medical reports and other documentation, are securely stored and not disclosed without permission, unless legally required.

Exceptions by Law: There are specific circumstances where confidentiality may be breached, such as:

If the client poses an imminent danger to themselves or others.
If there is suspected abuse or neglect of a vulnerable person (e.g., a child or elderly individual).
In compliance with a court order or legal subpoena.

7. LIMITATION OF LIABILITY

SYNC Therapies will not be held liable for any indirect, consequential, or punitive damages arising from the use of our services. In no event will our aggregate liability exceed the total amount paid by the client for the specific service in dispute.

8. INDEMNIFICATION

You agree to indemnify and hold SYNC Therapies harmless against all claims, losses, or expenses resulting from your use of our services or breach of these Terms.

9. THIRD-PARTY SERVICES

Our website or services may contain links to third-party websites or services, which are not under our control. We are not responsible for the practices or content of any linked websites and do not endorse these services.

10. MODIFICATIONS

We reserve the right to update these Terms periodically. Any significant changes will be communicated to clients, and continued use of our services after the changes signifies acceptance of the new Terms.

11. TERMINATION

Either party may terminate an agreement with written notice if the other party breaches a material obligation and fails to rectify it within a reasonable time. Upon termination, all outstanding fees are payable immediately.

12. GOVERNING LAW

These Terms are governed by the laws of the New South Wales jurisdiction, and any disputes will be resolved in the courts of this jurisdiction.
